Pre-contractual information according to Art. 3 para. 2 and 3 Data Act for networked products and associated services of Festool GmbH.

Various types of data may be collected and processed as part of the use of networked products (hereinafter referred to as "products") and connected services (hereinafter referred to as "app") from FESTOOL.

In the following, we would like to inform you about the type, scope and conditions of data provision in connection with our products and apps, in particular about technical and legal aspects that are relevant prior to the conclusion of a contract or the utilisation of the service.

Where personal data is involved, the provisions of the General Data Protection Regulation (EU) 2016/679 (GDPR) also apply, to which reference is also made in this document.

2. Nature and purpose od the data collection and processing

Product and connected service data are primarily used to ensure the functionality and (functional) security of both the product and the connected service, to enable the use of FESTOOL services, support individual user settings, facilitate maintenance and fault diagnosis, and contribute to future product improvements.

3. Scope of data collection, transfer of data, storage location

The amount of data processed depends on the usage behaviour, in particular the duration and frequency of use, interaction with the product and setting processes on the product and/or the app. Intensive use can therefore result in several hundred data points per week.

The product data is processed and stored locally on the machines. Data is transmitted wirelessly to FESTOOL exclusively via Bluetooth to the app. Data transfer requires the user to open a MyFestool account, store the relevant product in their user account, consent to data transfer and connect the product to the app for the specific application process. In this case, data is transmitted to FESTOOL cyclically and possibly several times a day. The transmission is encrypted. Data is not transmitted in real time.

Data stored locally on the machine can be retrieved and read out by FESTOOL. This is done exclusively for maintenance and repair purposes. The machines must be physically sent to FESTOOL for this purpose.

4. Data access, disclosure of data to third parties, intention of data use by providers and third parties

The data will be used by FESTOOL for the above-mentioned purposes. Data will not be passed on without express consent.

Exceptions exist insofar as

  • disclosure for the fulfilment of legal obligations,
  • as part of the provision of technical services (e.g. within the Group to connected systems of TTS Tooltechnic Systems AG & CO. KG; hosting services by contractually bound processors)

is required.

5. Processing of personal data

Product data is generally not personalised. If products are linked to a MyFestool account and the FESTOOL App, an assignment between the machine and a natural person and thus a personal reference can theoretically be established (e.g. by serial number and e-mail address in the account/access data app).

The legal basis for the processing is based on the purposes mentioned under point 2, in particular
